Words whose initial letters are capitalized have meanings determined under the following conditions.
The following definitions must have the same meaning regardless of whether the word is singular or plural.
For the purposes of the Terms and Conditions
“Application” means preprogrammed software provided by (*) and downloaded by you on any electronic device, named (*) App.
“Application Store” is a digital distribution operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) where the application is downloaded.
"Affiliation" is a form of cooperation or relationship between members or branches in a (*) or party, one of which is larger than the other, but each of which is independent.
“Account” is a unique account created by you to be able to access the (*) App services or parts of the services.
“(*)” refers to the (*) that created the (*) App.
“State” means the Unitary State of the Republic of Indonesia.
“Content” refers to content such as text, images, or other information that may be posted, uploaded, linked to, or otherwise made available by you, regardless of the form of such content.
“Device” is any device that can access services such as a computer, mobile phone, or digital tablet.
“Feedback” means feedback, innovations or suggestions provided by you regarding the attributes, performance or service features (*) of the App.
“Services” means the services provided within the (*) App.
“Terms and Conditions” are the terms and conditions that form the entire agreement between you and (*) regarding the use of the service.
“ Third Party Social Media Services ” means any service or content (including data, information, products or services) provided by a third party that may be displayed on, included in, or made available by the service.
“ User ” is a person who has registered on the Platform which provides property brokerage services, either in the form of a registered entity or as an individual (“Services”)
"Customer" is a buyer who purchases property using the Service from a User, where the User will be provided with information related to the property with the property listing on the Platform.
“Developer” is a property developer who has registered his property on the Platform.
“Commission” means revenue, which the developer pays to Users for Properties sold to Customers.
“You” means the individual accessing or using the service, or the company, or other legal entity on whose behalf such individual is accessing and using the service, as applicable.
These are the Terms and Conditions that govern the use of this Service and the Agreement that applies between you and SagoPro. These Terms and Conditions regulate the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Services.
By accessing or using the Services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these Terms and Conditions, you may not access the Service.
You represent that you are over 18 years of age. SagoPro does not permit those under 18 years of age to use the Services.
Your access to and use of the Services is also conditioned on your acceptance of and compliance with the SagoPro Privacy Policy. The SagoPro Privacy Policy explains SagoPro's policies and procedures on the collection, use and disclosure of your personal information when you use the Application or Website and tells you about your privacy rights and how the law protects you. Please read the SagoPro Privacy Policy carefully before using the SagoPro Services.
When you create an account with SagoPro. You must provide SagoPro with information that is accurate, complete and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on the SagoPro Services.
You are responsible for safeguarding the password you use to access the Services and for any activities or actions under your password, whether your password is with the SagoPro Services or a Third Party Social Media Service.
You agree not to disclose your password to any third party. You must immediately notify SagoPro upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
You may not submit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene, or otherwise objectionable. Examples of inappropriate Content include, but are not limited to, the following:
(*) reserves the right, but has no obligation, to, in its sole discretion, determine whether or not Content is appropriate and complies with these Terms, refuse or remove this Content. (*) further reserves the right to format and edit and change the manner of any Content. (*) may also limit or revoke your use of the Service if you post such inappropriate Content. Because (*) cannot control all content posted by users and/or third parties on the Services, you agree to use the Services at your own risk. You understand that by using the Services you may be exposed to content that you may find offensive, indecent, incorrect or objectionable, and you agree that under no circumstances will (*) be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.
Even though Content backups are performed regularly, (*) does not guarantee that there will be no loss or corruption of data.
Corrupt or invalid backup points can be caused by, without limitation, Content that was corrupted before being backed up or that changed while the backup was being performed.
(*) will provide support and attempt to resolve any known or discovered issues that may impact the backup of Content. But you acknowledge that (*) has no responsibility regarding the integrity of the Content or the failure to successfully restore the Content to a usable state.
You agree to maintain a complete and accurate copy of any Content in a location separate from the Services.
SagoPro respects the intellectual property rights of others. It is SagoPro's policy to respond to any claim that Content posted on the Service violates the copyright or other intellectual property infringement of any person.
If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement occurring through the Services, you must provide your notice in writing to SagoPro's copyright agent via email (____) and include in your notification a detailed description of the alleged violation.
You may be held liable for damages (including costs and attorneys' fees) for misrepresenting that any Content infringes your copyright.
By ordering Services through the SagoPro App, you guarantee that you are legally capable of entering into a binding contract.
If you wish to order Services available on the SagoPro App, you may be asked to provide certain information relevant to your Order including, without limitation, your name, your email, your telephone number, your credit card number, your credit card expiration date, address your billing, and your shipping information.
You represent and warrant that: (i) you have the legal right to use a credit or debit card or other payment method in connection with any Order ; and that (ii) the information you provide to (*) is true, correct and complete.
By submitting such information, you grant (*) the right to provide such information to payment processing third parties for the purpose of facilitating the completion of your Order.
SagoPro reserves the right to refuse or cancel your Order at any time for certain reasons including but not limited to:
SagoPro reserves the right to refuse or cancel your Order if fraud or an unauthorized or illegal transaction is suspected.
Any Services you purchase can only be returned or refunded in accordance with these Terms and Conditions.
SagoPro continually updates SagoPro Service offerings in the (*) App. Services available on the (*) App may be mispriced, described inaccurately, or unavailable, and SagoPro may experience delays in updating information regarding the Services on the (*) App and in (*) advertisements on other websites.
SagoPro cannot and does not guarantee the accuracy or completeness of any information , including prices, product images, specifications, availability and services. (*) reserves the right to change or update information and to correct errors, inaccuracies or omissions at any time without prior notice.
SagoPro reserves the right to revise its prices at any time before accepting an Order.
Quoted prices may be revised by SagoPro upon receipt of an Order in the event of any event affecting the price of the Services caused by government action, higher foreign exchange charges and other matters beyond SagoPro's control. In that case, you have the right to cancel your Order.
Payment can be made via various payment methods that SagoPro has, such as Visa, MasterCard, Affinity Card, American Express cards or online payment methods (PayPal, for example).
Payment cards (credit cards or debit cards) are subject to validation checks and authorization by your card issuer. If SagoPro does not receive the required authorization, SagoPro will not be responsible for any delay or non-delivery of your Order.
Any Promotions made available through the Services may be governed by rules that are separate from these Terms.
If you participate in any Promotion , please review the applicable rules as well as the SagoPro Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.
All rights to logos, brands, trademarks and service marks, information, elements and content contained on the Platform, in particular the brands, names and copyrights contained herein (together "Content") are owned by either SagoPro or the Developer in accordance with the rights to use those provided by third parties.
SagoPro does not claim copyright or grant rights to images or descriptions or property listings provided by the Developer. All use of this image and description is subject to the permission of the copyright owner and/or applicable legal requirements. All Content on the Site whether provided by SagoPro or by the Developer or via links to connect the site is the copyright of SagoPro/or the owner of the relevant site. Except as provided herein, none of the content on the Platform may be copied, reproduced, distributed, republished, downloaded, displayed, published or transmitted in any form or by any means, including but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the written permission of SagoPro or the owner of the linked site. However, Users will be permitted to share property listings with their Customers for the purpose of selling such properties.
SagoPro does not claim ownership of rights to text, files, images, photos, videos, sounds, musical works, written works, applications, or any other materials published by Developers on the Platform.
You assign all right, title and interest in any Feedback you provide to SagoPro. If for any reason such assignment is ineffective, you agree to grant SagoPro a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, sublicense, distribute, modify and utilize such Feedback without restriction.
The (*) Service may contain links to third-party websites or services that are not owned or controlled by (*).
(*) has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that (*) shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through such websites or services.

In order to register on our Platform, we ask you to complete a form (“Form”) that allows you to view specific property listing details. The form needs to be filled in with information including but not limited to name , e-mail address, cell phone number, office number, company name and address ("Personal Information"). Furthermore, we will collect data when you use the Platform to search for and view projects and units, share and upload documents, request to join a project, register, log in and update your account and communicate with our support: mobile device information such as device model , operating system and unique device identifiers and your location.

In addition to any legal or other equitable remedies, we may, without prior notice to you, immediately terminate your registered account and/or revoke any or all of your rights granted under the T&C, as permitted by applicable law. Upon termination of your registered account. You must immediately stop all access to and use of the Platform and we will , in addition to legal or other equitable remedies, immediately revoke all passwords and account identification provided to you and deny access to and use of the Platform in whole or in part. Any such termination will not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You further agree that SagoPro shall have no liability to you or any other person as a result of any suspension or termination. If you are dissatisfied with the Platform or with any terms, conditions, regulations, policies, guidelines or practices of SagoPro in operating the Platform, your sole and exclusive remedy is to discontinue use of the Platform.
We and/or our colleagues, subsidiaries, directors, employees, affiliates, licensees, business partners and agents are not responsible and liable for:
No agency, partnership, joint venture, employee-employer relationship or franchise relationship is intended or created by this Agreement.
SagoPro provides all materials and information available through this Platform “as is”, “with all faults” and “as available”. The Platform may contain technical inaccuracies, out-of-date information and typographical errors. The risk of satisfaction with quality, performance, accuracy and effort lies with the User. SagoPro in particular does not assume or guarantee anything in relation to goods or services provided on the Platform or any potential contractual relationship as a purchase or rental agreement. Information provided on the Platform should be viewed as an invitation to bid and not as a legally binding action or recommendation to buy or sell specific goods and services. SagoPro is not a party to any contracts potentially created between Users and publishers of goods on the Platform.
The laws of the Country, excluding its conflict of law rules, will govern these Terms and your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

If there is any difference, dispute, conflict or controversy ("Dispute"), arising from or in connection with these T&C or its implementation, including but not limited to disputes regarding the existence, validity, termination of the rights or obligations of any User, the User and SagoPro ("Parties /Parties") will try within a period of 30 (thirty) days after receipt of notification by one of the Parties to the other party in the Dispute to resolve the Dispute through peaceful settlement between the Parties.
If there is no result of an amicable settlement carried out by the Parties then any Party can submit the Dispute to the International Chamber of Commerce (ICC) under the ICC Arbitration Rules and the arbitration award will be final and binding on the Parties. The arbitration shall be conducted by a single arbitrator. The place of arbitration is Jakarta, Indonesia. The language of the proceedings is English.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
(*) reserves the right, at (*)'s sole discretion, to modify or replace these Terms at any time. If a revision is material, (*) will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at (*)'s sole discretion.
By continuing to access or use the Services (*) after such revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and Services.
